PRIVACY NOTICE FROM FRASA Desarrollos, S.A.P.I. de C.V. (hereinafter, “THE COMPANY”)
In compliance with the provisions of the Ley Federal de Protección de Datos Personales en Posesión de Particulares ("LFPDPPP"), its Regulations, and other applicable provisions, THE COMPANY, with registered office at Blvd. Fundadores No. 3078-J, Col. Juárez, Tijuana, Baja California, Mexico, makes this Privacy Notice available to you, through which it informs the ("OWNER") about the practices it applies for the collection, processing, use, and, where applicable, transfer of your personal and sensitive data.
I. Responsible party
THE COMPANY is responsible for processing the personal and/or sensitive data that you provide, either directly or through your representatives, by any means (written, oral, electronic, or digital), within the framework of an employment, commercial, supplier, or any other type of relationship.

In accordance with the relationship you maintain or may maintain with THE COMPANY, it may collect, compile, store, safeguard, share, transmit, and use the personal and/or sensitive data that you voluntarily provide, including but not limited to:

The personal data you provide will be processed for the following purposes:
a) To fulfill obligations arising from any employment, commercial, contracting, supply, or other relationship that you have or may have with THE COMPANY.
b) For billing, collection, granting of credit or guarantees, customer service, sales force, security, control, and surveillance.
c) To carry out marketing, advertising, telemarketing, sending offers, promotional messages, surveys, statistics, market studies, contests, raffles, events, participation in social networks, chats, or discussion forums.
You may object to the processing of your personal data for the purposes mentioned in this section, using the mechanisms indicated in section IV.

The fact that you provide your personal data, documentation, or video recordings constitutes your expression of consent to this Privacy Notice, which implies that you have read, understood, and accepted its contents.
V. Data transfers
In order to fulfill the aforementioned purposes, THE COMPANY may transfer your personal data to third parties, whether domestic or foreign, including consultants, service providers (collection, technical support, information technology), affiliated companies, parent companies, subsidiaries, acquirers, authorities, or agencies. THE COMPANY will guarantee through agreements that such third parties apply adequate administrative, technical, and physical security measures and use personal data only for the purposes for which it was collected.
VI. Video recordings, photography, and audio recordings
People entering THE COMPANY's facilities may be recorded by video, photograph, or audio for the purposes of control, surveillance, and security of people, material resources, and human resources. The recordings will be kept for a period of 7 to 10 days at the COMPANY's registered office, unless specific circumstances require them to be kept for a longer period.
VII. ARCO rights and revocation of consent
You have the right at any time to access, rectify, cancel, or oppose the processing of your personal data (ARCO rights), as well as to revoke the consent granted, without retroactive effect. To do so, you must submit a request in writing or via email (info@frasa.com.mx), proving your identity or legal representation, and clearly indicating the data on which you are exercising your right, as well as providing the documentation supporting your request. THE COMPANY will issue an acknowledgment of receipt and respond to your request within a maximum period of fifteen (15) business days from the moment your request is received on THE COMPANY's server.
VIII. Blocking and deletion of data
Once your personal data has been deleted, THE COMPANY will retain it for an additional month solely for the purposes of clarification and preparation for deletion. After this period, the data will be permanently blocked, with no possibility of being located or used again.
IX. Security measures
THE COMPANY has established the necessary administrative, technical, and physical security measures to protect your personal and sensitive data against damage, loss, alteration, destruction, or unauthorized access. Only authorized personnel who have complied with confidentiality requirements may have access to the processing of such data. This confidentiality obligation remains in effect even after the relationship with THE COMPANY has ended.
X. Websites and automatic capture technologies
THE COMPANY may collect personal data automatically through its website or tools such as cookies, web beacons, or links, which allow it to obtain information sent by the browser or information about user behavior. You can disable these mechanisms through your browser settings.
XI. Changes to the Privacy Notice
THE COMPANY reserves the right to modify this Privacy Notice at any time. Modifications will be notified by the means THE COMPANY deems most appropriate (email, website notice, direct communication, print media). Once updated, the modifications will be effective immediately after their publication on THE COMPANY's website. Continued use of the services or relationship with THE COMPANY after publication of the modified Notice shall be deemed express acceptance thereof.
XII. Jurisdiction and applicable law
This Privacy Notice, the processing of your personal data, and related documents are governed by the LFPDPPP and other applicable laws of the United Mexican States. For any dispute arising from this Notice, the parties submit to the jurisdiction of the competent courts of the City of Tijuana, Baja California.

The headings used in this Notice are added solely for ease of reading; they do not affect the meaning or scope of the provisions contained herein.
By accepting or continuing your relationship with THE COMPANY, you acknowledge that you have read, understood, and agree to this Privacy Notice.
